These Terms of Service ("Terms") govern your use of the Koala mobile application ("App," "Koala," "we," "us," or "our"), operated by ThreeSix Labs, Inc., a Delaware corporation. By downloading, installing, or using Koala, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
By accessing or using Koala, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Koala is available for users aged 4 and older. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting updated Terms within the App or through other reasonable means. Your continued use of the App after such notice constitutes acceptance of the modified Terms.
Koala is a gamified screen time management application that helps users reduce phone usage through app blocking features, scheduled restrictions, and a reward system.
The App utilizes Apple's Screen Time API to:
All blocking and restriction functionality occurs locally on your device. We do not remotely control your device or its settings.
Koala does not require account creation. All app functionality operates independently on your device using anonymous user identifiers.
Koala offers the following subscription options:
Subscriptions are billed through your Apple App Store account. Payment will be charged to your Apple ID upon confirmation of purchase (or after the free trial period ends, if applicable).
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period.
If you subscribe to the Yearly with 3-Day Intro option, you will have 3 days to use the App free of charge. You may cancel during the trial period without being charged. If you do not cancel before the trial ends, you will be charged the full subscription price.
All payments are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with Apple's refund policies. We do not control or process refunds directly.
We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect active subscriptions until renewal.
You agree to use Koala only for lawful purposes and in accordance with these Terms.

KOALA IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that:
Koala relies on Apple's Screen Time API, which may have limitations, bugs, or changes beyond our control. We are not responsible for functionality issues arising from Apple's API.
While Koala blocks access to selected apps during restriction periods, emergency services (such as calling 911 or emergency contacts) remain accessible at all times. The App does not and cannot block emergency functionality.
We are not liable for any missed calls, messages, notifications, appointments, or other communications that occur as a result of app blocking features. You are responsible for configuring your blocking schedules appropriately.
Koala is a productivity and screen time management tool. It is not intended to diagnose, treat, cure, or prevent any medical condition, including addiction or mental health disorders. Consult a healthcare professional for medical advice.
The App integrates with third-party services including Firebase (analytics) and RevenueCat (subscription management). We are not responsible for the performance, availability, or practices of these third-party services.
TO THE FULLEST EXTENT PERMITTED BY LAW, THREESIX LABS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless ThreeSix Labs, Inc., its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, judgments, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

We do not collect personally identifiable information. All data is associated with anonymous user identifiers only.
Since data is not linked to individual identities and no accounts are created, analytics data is retained in aggregate form for operational and improvement purposes. Individual device data cannot be specifically identified or deleted.

Koala, including all content, features, functionality, software, code, designs, graphics, user interface, and the koala mascot, is owned by ThreeSix Labs, Inc. and is protected by United States and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not:
Eucalyptus leaves and any other in-app rewards or virtual items have no cash value and cannot be exchanged for money or other items of monetary value.
You may stop using the App at any time by deleting it from your device and canceling your subscription through the Apple App Store.
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe:

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.
We may add, change, or remove features from the App. Material changes to core features will be announced with at least 30 days' notice when reasonably possible.
We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App or any part thereof.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to personal jurisdiction in such courts.
Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction.
Either party may bring an individual action in small claims court as an alternative to arbitration.
YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThreeSix Labs, Inc. regarding the App and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
